The next change in the Family Code is related to the adoption of children! Following the decision of the Ministry of Justice, for the first time the adoption of children who have lived together for at least 3 years with each other, but also by a single person will be allowed.
Adoptive parents will be given the right to adopt more than one child. The Minister of Justice, Etilda Gjonaj said that this change will simplify the procedures and will guarantee more security.
-For the first time we have the adoption permit for cohabitants, who have lived together in a stable and continuous manner for at least 3 years, but also by a single person.
-The adoptive parents are allowed several adoptions, with successive acts, and it is an advantage if the adopter has adopted the brother or sister of the child who is intended to be adopted or the application to adopt other siblings, or show willingness to adopt minors who are in difficult health or social conditions.
A novelty is the adoption of a new provision forcing the court and the child protection unit at the local government to inform the child's parents about the purpose, legal conditions and consequences of consent for adoption.
- The Family Code for the first time provides for the transcription of the court decision, which when it becomes final is transcribed in the civil registry of the place of birth of the adopted child. This transcript contains no data about the child's biological parents.
In recent years there has been a significant decrease in the number of adoptions. From 52 in 2015, we have only 24 adoptions in 2019, which makes such policies even more necessary.
